1930's Growing Tobacco Lindley Style

Durland Weale of Addison formerly of Lindley will present a program on Growing Tobacco in Lindley in the 1930's on Saturday, October 14th from 2 to 4 p.m. at the Lindley Town Hall on U.S. Rt. 15.

Mr. Weale had first hand experience in the raising of tobacco as a youth during this period on his parent's farm in Lindley. The talk will describe the various steps associated with growing a tobacco crop. Examples of locally grown tobacco and the equipment used in growing tobacco will be on display. This promises to be an educational and informative program on the history of an extensive farm crop that no longer exists in this area.

Too Much Rain

Hi Sally-
A gentle reminder of what used to happen in Lindley before the days of the flood control dams. Mrs. Verna Austin had this picture which was taken a few weeks after they bought the former Lee Bulkley's store(right hand -side of photo).from Smitty Pease in November 1950 and which was flooded a few weeks later... As a result , they enclosed to the porch of the house at the end of the Lindley bridge for use as a store. They built the building next to the present Town Hall for their store when the "new" Route 15 was opened in 1953. Many of us old timers still call the house in the photo the Crandall house from the Elmer Crandall family who lived there after the Austins.
Found an article recently that stated the dams were being discussed as early as 1956, but were not built until 1975----a direct result of the 100 years flood of 1972.
I am sure the pictures of the flooding to the east of here last week brought back memories of the flood of 1972- almost 34 years to the date to many people .

Found the following information in. Roberts Historical Gazetteer 1891

"Presho formerly Erwin Centre -so called because it was in the center of the Town of Erwin before Lindley was taken off-is located near the northern boundry of the Town of Lindley on the F.B.C.(Fallbrook, Blossburg, Corning) railroad. It contained one church built for the union church,but soon after for some unknown reason dedicated as a methodist house,two stores,one blacksmith shop and wagon repair shop, a school,and thirty or forty families. Formerly, it was a great lumbering point,but now is the center of extensive tobacco growing and farming district.On January 9,1888, the post office was changed to Presho in honor of one of the most public spirited citizens of the hamlet, Thomas J. Presho and on May13 following,the name of the station and express office were changed to Presho.
Thomas J. Presho (son of Josiah N. and Betsy Cutiss) Presho was born in Broome County,New York August 21,1828.The family lived at Dalton, near Pittsfield,Massachusetts prior to their settlement on Broome County. The subject of this notice,after a residence of some years in Bradford Co,Pa. ,he came to this town and settled at Erwin Centre(now Presho)

I would like to say thank you to all the blog readers and others who attended the program on the Civil War at the Lindley Town Hall on Thurs. evening. It was gratifying to see such an interest in our local history. Hopefully, more such programs can be presented.
A special thanks to the people who brought their children and grandchildren.I was pleased to see that many there. I am a firm believer in this type of exposure to history. As a mother of four -all who are "history buffs" of some sort, I can't help but feel that the vacation time we spent going to historical places and events has had an influence on their interests and lives. It trickles down to the next generation,also. Our oldest grandson has his Masters in History and starts Arizona State this fall on his PHD in History. As historians like to quote " We have to know where we have been to know where we are going. "
Will probably miss someone, but a special thanks to Dee Hill for always being such a great helper, to Mary Lentzen for borrowing the projector and getting people seated, for Sally Orr for her support and encouragement and everyone else who helped things move along so smoothly. You are a great bunch of people and the program went well thanks to all of you. Shouldn't forget my most valued helper-my husband ,Dick. Thank you all. Doug and Terri were impressed and have offered to come back again with another topic.

While I have your attention - a quick report on the Veteran's Project.. With feedback from the blogger poll, it was decided at Town Board meeting to go with option #3( the shaft type marker). Paul M. is working on specifications that will be used to obtain bids from monument dealers. Donations given at Thurs. night's meeting totaled $131 and Dee has collected over $500 so far and will continue to accept donations due to the interest and support that has been expressed.
Lindley's veterans have served their country well and it is is only fitting that we recognize their efforts.

Answering the Call 1861-1865

A program Answering the Call 1861 –1865 will be presented at the Lindley Town Hall at 7 P.M. on

May 18th by Doug and Terri Oakes. The presentation will discuss Lindley’s contribution to the American

Civil War, including how volunteers were recruited, the regiments they joined, and a display of uniforms

and equipment used by the soldiers. Many soldiers from Lindley served in Co. F of the 86th Regiment

which Doug and Terri are currently researching. The Oakes from Wellsburg have been presenting programs

on the Civil War for several years and have extensive knowledge about local participation. The public is

invited to hear how men from Lindley answered the call.

Names of men from Lindley and the Regiments in which they served will be available that evening.

Giving speeches or facing a left handed pitcher with a wicked fast ball is all about testing your grit. And the great game of baseball has tested many.

Each of you in the coming weeks will discover that Little League baseball is a bigger than life drama. One game you'll be a hero and the next game you'll be a goat. But that is the lesson of baseball. And that is the lesson of life.

Some will tell you it's all about winning. And some will say it's how you play the game. Both are right. Baseball is a game of competition. The ultimate goal is to beat the other team. But it's also a game of individual successes and failures.

When you miss the big play or sit the bench. Shake it off. Losing builds character. Learn how to fail with dignity and know that another chance to come thru in the clutch or hit the big home run is jut but a game away. It is your destiny.

Learn how to win with integrity and never forget that you are a member of a team. A part of something bigger than yourselves.

Listen to your coaches and let them teach you. Practice and learn the skills of baseball well. Play hard and play fair. Seek the glory as a team. Seek the glory as a lone player. But most of all play for the pure joy of playing the great American pastime.

Good luck and may you all have stories of an impossible catch or the run that broke the tie to win the game to tell your children from the days you played on this Field of Dreams.

John Ryerss

Hi Sally- Thought your readers might find this of interest.
It explains the origin of the name Ryers in Lindley.

After 43 years , we finally located the grave of John Ryerss in Corning's Hope Cemetery.
It all goes back to an article on Lindley's history that Dick sent to the Leader in 1963 and was published. As a result ,we received a letter from a man who owned a lot in Hope next to the Ryerss stone and he was concerned because the shaft was leaning way back then. Occasionally, we would drive through looking with no luck. On Tues, we saw some caretakers working there and asked them. Fortunately-because one of the men remembered Lindleytown on the inscription-we were able to go right to the stone. This is a long impressive stone, flat on the ground now ,but lies so we could copy the inscription. " Sacred to the memory of John Ryerss(note spelling) who was born on Staten Island March 13, 1772. Died at Campbelltown April 24, 1839. He was one of the first settlers of Lindleytown to which place he came in 1797."

John was the son of the Ryerss who with a Garretson(Garrison) purchased the northern half of Lindley from Col. Lindsley about 1792. (11,520 acres)
Garretson received 1/2 (5,760 Acres) of this on the West side of the Tioga River . This would eventually be deeded to his son-in-law Joshua Mersereau -the Revolutionary War soldier and spy buried in Presho Cemetery. Some old Presho deeds refer to this as the Mersereau Tract) Ryerss received his 1/2 of the land on the East side of the Tioga. One old history mentions that John Ryerss had a store .All these men were engaged in the lumber industry so we can only speculate that this is what took John to Campbelltown where he died. .

Veteran's Project Fund Raiser

The Lindley Town Board and Heritage Days Committtee have announced plans to to raise funds to purchase a granite marker to display a plaque which reads" To Honor Those of our Town -Living and Dead who served our Country".

The plaque was purchased by the Lindley Town Board in 1960 and was mounted in the base of the flag pole at the former Town Hall until 1972 when the town offices were moved to the present location. The plaque has been in storage for a number of years and needs to be refinished and mounted on a permanent marker.

The organizations felt that the public should be invited to participate in the project. The plaque and marker would be placed near the flag pole of the Town Hall. Lindley residents are proud of their Heritage and would like to honor the people who have served their country beginning with the Revolutionary War Soldiers buried in the cemeteries.

Donations can be sent to Heritage Days at Box 62 Lindley,New York14858 Attn: Diana Hill. until May 15th. Checks should specify Veteran's Project. For more information, contact Diana Hill at 523-8816 or Catherine Pierce at 523-8851. A rededication ceremony will be planned for a later date.

Don's Okay

Last night my grandson Don was airlifted to Arnot Hospital after crashing his dirt bike into the iron RR bridge across from Herrick's on the River Road. Aside from minor scrapes and bruises he broke his femor bone, the largest bone in the body, clean in half. Doctors told the family that Don will undergo multiple surguries to put his leg back together. Although he sustained a badly broken leg we are grateful that his injuries weren't life threatening.

I want to thank everyone who was at the scene for their time and professional care they gave to Don and the family.

Are You Laughing?If they know of him at all, many folks think Ben Stein is just a quirky actor/comedian who talks in a monotone. He's also a very intelligent attorney who knows how to put ideas and words together in such a way as to sway juries and make people think clearly.~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~The following was written by Ben Stein and recited by him on CBS Sunday Morning Commentary, Sunday, 12/18/05.

Herewith at this happy time of year, a few confessions from my beating heart: I have no freaking clue who Nick and Jessica are. I see them on the cover of People and Us constantly when I am buying my dog biscuits and kitty litter. I often ask the checkers at the grocery stores. They never know who Nick and Jessica are either.

Who are they? Will it change my life if I know who they are and why they have broken up? Why are they so important?I don't know who Lindsay Lohan is either, and I do not care at all about Tom Cruise's wife.Am I going to be called before a Senate committee and asked if I am a subversive? Maybe, but I just have no clue who Nick and Jessica are.If this is what it means to be no longer young. It's not so bad.

Next confession: I am a Jew, and every single one of my ancestors was Jewish. And it does not bother me even a little bit when people call those beautiful lit up, bejeweled trees Christmas trees. I don't feel threatened. I don't feel discriminated against. That's what they are: Christmas trees.It doesn't bother me a bit when people say, "Merry Christmas" to me. I don't think they are slighting me or getting ready to put me in a ghetto. In fact, I kind of like it. It shows that we are all brothers and sisters celebrating this happy time of year. It doesn't bother me at all that there is a manger scene on display at a key intersection near my beach house in Malibu. If people want a creche, it's just as fine with me as is the Menorah a few hundred yards away.

I don't like getting pushed around for being a Jew, and I don't think Christians like getting pushed around for being Christians. I think people who believe in God are sick and tired of getting pushed around, period. I have no idea where the concept came from that America is an explicitly atheist country. I can't find it in the Constitution, and I don't like it being shoved down my throat.Or maybe I can put it another way: where did the idea come from that we should worship Nick and Jessica and we aren't allowed to worship God as we understand Him?

I guess that's a sign that I'm getting old, too.But there are a lot of us who are wondering where Nick and Jessica came from and where the America we knew went to.In light of the many jokes we send to one another for a laugh, this is a little different: This is not intended to be a joke; it's not funny, it's intended to get you thinking.

Billy Graham's daughter was interviewed on the Early Show and Jane Clayson asked her "How could God let something like this Happen?" (regarding Katrina)Anne Graham gave an extremely profound and insightful response. She said, "I believe God is deeply saddened by this, just as we are, but for years we've been telling God to get out of our schools, to get out of our government and to get out of our lives.And being the gentleman He is, I believe He has calmly backed out. How can we expect God to give us His blessing and His protection if we demand He leave us alone?"

In light of recent events...terrorists attack, school shootings, etc. I think it started when Madeleine Murray O'Hare (she was murdered, her body found recently) complained she didn't want prayer in our schools, and we said OK.Then someone said you better not read the Bible in school . The Bible says thou shalt not kill, thou shalt not steal, and love your neighbor as yourself. And we said OK.Then Dr. Benjamin Spock said we shouldn't spank our children when they misbehave because their little personalities would be warped and we might damage their self-esteem (Dr. Spock's son committed suicide). We said an expert should know what he's talking about. And we said OK.Now we're asking ourselves why our children have no conscience, why they don't know right from wrong, and why it doesn't bother them to kill strangers, their classmates, and themselves.Probably, if we think about it long and hard enough, we can figure it out. I think it has a great deal to do with "WE REAP WHAT WE SOW."

Funny how simple it is for people to trash God and then wonder why the world's going to hell.Funny how we believe what the newspapers say, but question what the Bible says.Funny how you can send 'jokes' through e-mail and they spread like wildfire but when you start sending messages regarding the Lord, people think twice about sharing.Funny how lewd, crude, vulgar and obscene articles pass freely through cyberspace, but public discussion of God is suppressed in the school and workplace.

Are you laughing?Funny how when you forward this message, you will not send it to many on your address list because you're not sure what they believe, or what they will think of you for sending it.Funny how we can be more worried about what other people think of us than what God thinks of us.Pass it on if you think it has merit. If not then just discard it... no one will know you did. But, if you discard this thought process, don't sit back and complain about what bad shape the world is in.

The Veteran's Project

Dear Blog Readers: An explanation as to the photos of markers for the Veteran's Memorial seems in order.

This all started when I asked Harold Semple about the location of a plaque for Veterans which the 1960 Town Board purchased and was originally mounted at the base of the flag pole next to the "Old LindleyTown Hall". Harold explained that it had been moved to the flower bed in front of the present Town Hall. When the flower bed was redone, the plaque was placed in Harold's office with the idea of obtaining a suitable marker for it.

Last Fall-2005, I asked the Board for permission to check out prices for such a stone. By the time I had the prices it was the end of the year. With Harold's term of office ending and Sally's beginning, I decided to wait until the March Town Board meeting to make the presentation.

Afterdoing so, several members of the audience indicated an interest in assisting with the purchase. This offer made several of us rethink the project. Originally, the idea was for the Town to purchase the marker for the plaque at the prices shown on the blog. However, before proceeding further, we decided to obtain input from the townspeople as to whether or not there was enough interest to ask for donations from the community as well as from theTown Board.

With support from the community, it might be possible to obtain a really nice memorial to honor the Veteran's of Lindley. Our idea is to place this in front of the flag pole at the present Town Hall . Sally has offered to create a poll on the blog to help decide which monument the Town prefers.

The rate in Washington D.C. is 80.6 per 100,000.

That means that you are about 25% more likely to be shot and killed in our Nation's Capitol, which has some of the strictest gun control laws in the nation, than you are in Iraq.........................Conclusion: We should immediately pull out of Washington

Hi,There is a warning almost everyday about a new scam. Some of the warnings are scams in that they are false or intended to upset people. This warning appears to be real based on the write-up at the Snopes site.

Subject: Jury Duty Scam Heed this message. Jury Rigged - I checked with Snopes to verify authenticity....it is true.Most of us take those summonses for jury duty seriously, but enough people skip out on their civic duty, that a new and ominous kind of scam has surfaced.Fall for it and your identity could be stolen, reports CBS News.

In this con, someone calls pretending to be a court official who threateningly says a warrant has been issued for your arrest because you didn't show up for jury duty. The caller claims to be a jury coordinator. If you protest that you never received a summons for jury duty, the scammer asks you for your Social Security number and date of birth so he or she can verify the information and cancel the arrest warrant. Sometimes they even ask for credit card numbers. Give out any of this information and bingo! Your identity just got stolen.

The scam has been reported so far in 11 states, including Oklahoma, Illinois, and Colorado. This (scam) is particularly insidious because they use intimidation over the phone to try and bully people into giving information by pretending they're with the court system.The FBI and the federal court system have issued nationwide alerts on their websites, warning consumers about the fraud.Check it out here: http://www.snopes.com/crime/fraud/juryduty.asp

Resolving the WMD Mystery

If you've been wondering why Main Stream Media hasn't been yipping about Bush lying about Saddam's Weapons of Mass Destruction lately, this is why:

There they sit. Forty-eight thousand boxes containing thousands upon thousands of documents from the Saddam Hussein regime stacked variously to the heavens, entirely filling a desert warehouse where Central Command has its headquarters in Qatar—a message in a bottle writ as large as Wal-Mart. Three years since U.S. soldiers swept into Baghdad and began collecting pages out of Saddam's playbook on a regime allegedly involved in terrorism, in propagating weapons of mass destruction, and in plotting deadly war against the United States, that regime's written and audiotaped record remains largely unexamined, barely translated, and—until this month—grossly underestimated.

Some choice excerpts from the article in World Magazine:

Sorting wheat from chaff is "long, slow, and tedious, but this is what intel is," said Bill Tierney, an Army linguist who helped jumpstart the document dumping in February by publicizing 12 hours of Saddam on tape he had translated from Arabic to English. The recordings, released at the national Intelligence Summit in Washington last month, include Saddam discussing a previously undisclosed nuclear weapons program and promising in the mid-1990s that the United States would be visited in the future by "terrorism with weapons of mass destruction." This latest set of disclosures, Mr. Tierney told WORLD, "is a haystack. And there are definitely jewels hiding in it, but it is difficult to find them."

Faced with mounting pressure from Congress and the media to allow public access to some of the estimated millions of printed records and over 500 hours of audiotape, Director of National Intelligence John Negroponte agreed March 16 to release select documents. Within days the directorate posted 125 separate items at its Foreign Military Studies Office website (fmso.leavenworth.army.mil/products-docex.htm) and added to a roster of terrorism-related documents already available in a West Point database (www.ctc.usma.edu/harmony_docs.asp).

Amir explains.

A handwritten dossier dated Aug. 17, 2002, confirms an operational cell of al-Qaeda inside Iraq and identifies its key member as Ahmed Fadil Nizal Al Khalaylah—also known as Abu Musab al-Zarqawi, the current leader of al Qaeda in Iraq. Saddam's regime, from the document, seems little concerned about the terrorist's presence—even though tolerating known terrorists violated UN resolutions—and less surprised, perhaps with reason. The Beginning of Zoning Laws

The first New York City Zoning Resolution was created in 1916 in response to overwhelming development in Lower Manhattan.

Technical restraints that had traditionally limited building height vanished with the introduction of steel beam construction techniques and improved elevators. The Manhattan skyline was beginning to assume its distinctive form. Multifamily residences, particularly in Manhattan, were growing in popularity and new retail districts were springing up to meet new demands. Office space was expanding; by 1900, New York City had become the financial center of the country.

Although the concept of enacting a set of laws to govern land use was revolutionary, the time had come for the city to regulate its physical growth. The huge shadow cast by the 42-story Equitable Building, built in 1915 on lower Broadway, deprived neighboring properties of light and air. Warehouses and factories were intruding into fashionable retail areas on lower Fifth Avenue.

The pioneering 1916 Zoning Resolution, though a relatively simple document, established height and setback controls and separated what were seen as functionally incompatible uses -- such as factories -- from residential neighborhoods. The ordinance became a model for urban communities throughout the United States as other growing cities found that New York's problems were not unique.

But while other cities were adopting the New York model, the model itself refused to stand still. New transportation systems changed land use patterns and created traffic and parking problems never dreamed of in 1916. The Resolution was constantly amended in response to the changing needs of the changing city -- new technology, changes in land use, population shifts and a continuing influx of immigrants who needed housing. The amended Resolution also had to meet the New York State requirement that it be in accordance with a "well-considered plan."

In 1926, the U.S. Supreme Court validated the zoning ordinance of Euclid, Ohio, in the landmark case of Village of Euclid v. Ambler, finding that it rested on a comprehensive plan for maintaining, protecting and upgrading the community. The Court recognized that zoning is an appropriate extension of the community's authority to pass laws related to protecting the public health, safety, morals and general welfare. The historic opinion also contained a far-seeing passage suggesting that zoning must evolve to meet the changing needs of changing times: ". . . the meaning of constitutional guarantees never varies, the scope of their application must expand or contract to meet the new and different conditions which are constantly coming within the field of their operation."

The scope of the 1916 Zoning Resolution did expand greatly to meet the new and different conditions but, after 45 years of rapid changes in the country and the City, it was clear that there was a need for a total reconsideration of zoning in New York City.

The current Zoning Resolution was enacted after lengthy discussion and public debate and took effect in 1961. It coordinated use and bulk regulations and incorporated parking requirements. It introduced the concept of incentive zoning by offering a bonus of extra floor area to encourage developers of office buildings and apartment towers to provide public spaces.

The new Resolution was a flexible document but it also had some shortcomings which surfaced with the experience of time. New approaches have been developed since passage of the 1961 ordinance to deal with some of the problems that have emerged. Many planning tools, including incentive zoning, contextual zoning, waterfront zoning, mixed use zoning, special districts, air-rights transfer and restrictive covenant techniques, have been used to make zoning more responsive and sensitive to the changing needs of New York City and the people who live and work here.

Cities never stand still, nor should zoning.

The regular meeting of the Lindley Town Planning Board was called to order at 7:00 p.m. by Chariperson, Mary Lentzen. Members present were Earl Titus, Mark Swan, Jim White, Gerry Gross, Fran Tempel and Pat Simcoe. Two visitors were also present. The CEO, Dave Fuller, was on vacation.

Minutes of the February meeting were read; a Motion to accept the minutes as read was made by Earl, seconded by Gerry and passed unanimously.

Mary stated she had prepared a letter to accompany the transfer of the Conditional Use Permit for the Fred Robbins' mining operation located on River Road near Morgan Tax Map #406.00-01.029.100 to Ronald Cianciulli of Tyjor Corp, Islip, NY. However, before the letter could be sent the NYDEC issued a "Cease and Desist" order on the operation. It was noted that Mr. Robbins had not complied with the conditions set forth in his CUP before beginning his mining operation which caused mud and water damage to the River Road.

Mary, Pat, Fran and Jim (maybe) plan on attending the April 13 Regional Leadership Conference at Corning Community College.

The Board began a discussion of ways to increase residents' awareness of the Town Zoning Law.
Residents need to know results from previous surveys, where the Town Zoning Law comes from (most is from NYS Zoning Law), what is included in the Zoning Laws, and what is the Comprehensive Plan.

Fran will draft the first article on What the Planning Board Does for publication in the Addison Post. It was noted that residents with Corning or Painted Post addresses do not receive the Post but extra copies can be made available at the Town Hall. Future articles will include the Building Permit Process, Home Business requirements and Sub-Division Law. Mark suggested that information be included with the Building Permit Packets as it is done in other towns. Residents with questions may direct them to Dee Hill who can contact the appropriate Board member for a response.

The Board agreed that residents need to have easy access to information and clear, concise answers to their questions. A Town Website was suggested. Mary will check with Jennifer Fais as to whether or not the Town Zoning Law and the update on the Farm Land survey have been posted on the Steuben County Website, noting that Lindley has a page on the county website. Mark will contact Ken Peasely about construction of a Town of Lindley Website.

At 7:45 PM Earl made Motion to adjourn, Gerry seconded and the Board unanimously agreed.

It is noted that a monthly report was received from the Town Supervisor, & Town Clerk & Highway Dept. & Code Enforcement for the month of January 2006, they are on file in the Town Clerk’s office, for your viewing.

1.) Fran Woodring & Bill Canfield: spoke on Area Wide transportation Meeting (Route 15). First off, and most important, the committee and George Winner want to get the State Dept. of Transportation to make this route 15/I99 project the top priority for the Dept. This means that not only is the state senator now committed to our route 15 conversion, but Corning Inc... In the guise of our Wide Area Transportation Committee, (Tom Tranter, who chairs the committee is Corning Inc. lead man on public relations) is now also committed to completing this project. Bill invited the Town Board members to this Meeting. Bill asked the Town board to endorse the attendance to the meeting. Lindley is important to Corning Inc. There is a copy on this report on file in the Clerk’s Office.
2.) Dick Johnson Highway Supt.: report on the CHIPS Fund: 2005 initial $66,069.35
Paid in 2005 Dec 15, -$44,000.00
Rollover Balance: $43,024.71
2006 estimated $66,069.35 + up to 3%
Available amount for CHIPS: ($109,094.06)

They will only allow the Towns to use CHIP money for 10 year projects. Dick will set projects up for next month’s meeting:
The multi model money of $25,000 is available for the Mulholland. Road.
3.) Citizen report: Gene Steinhilper: reported on Church Creek Rd. (County Route 106). They are working on the road some spots better, some spots still need work.
4.) Report from Guy Hill, Chairman of Assessors, on Fortuna Tax assessment investigation/process.
5.) Paul Mortzheim gave an update on the status of the demolition of the Old Highway Building, there is no set time for the demolition, most likely in the spring or summer, Dick will work on this, when he can, so it will not cost the Town anymore money, when we tear the shed down, it will go to the peak of the roof. So the gas pumps are still covered. The town board is here to work with Dick on this project. Kitty asked that when Dick is tearing down the building, please look for the Veteran Board.

UNFINISHED BUSINESS

NEW BUSINESS

A. (Note: Every “Business item” on the Agenda that requires the Board to “make a decision” needs a Motion, a second to debate (No second, No debate and a Majority Vote).
1.) Motion to purchase (A) Dodge Ram 2500 ¾ ton Pick-up Truck for the Lindley Highway Superintendent.

The only change is the rubber mat in the bed on the truck, which is no charge.
Jake asked Dick what you are going to do with the old pick-up.
Dick: will put the truck up for Bid-will advertise in the Legal Notices-
Jake feels we should at least have the bid up to $4000.00. As last October the Town put a new transmission in the truck, the cost was about $4000.00, we will be throwing away that money. If we can’t get this amount for the Truck, we should put a gas tank in the back and let the Highway guys use the truck, until it dies. Then take it to pick a part.
(Town Board asked for a minimum Bid of $4000.00 dollars for the Truck). Jake Also wants a deadline on the sale of the Truck.
Paul Stermer: you have to wait until the new truck comes before you can do anything with the Bid.
Paul Mortzheim: comment to Jake we should use that truck as much as we can. Use until we can get the money for the truck.
Sally Orr: Dick this is your call, what to do with this truck.
Gerry: Can we make a motion without a figure?
Sally: the amount of $32,000.00 was budgeted for the vehicle.
Dick the amount of the new truck is $22,000.00.

2.) Announcement concerning Town Clerk approval to close the Town Clerk’s office: I Faxed a copy of the local Law to Kent Woloson, He said I have to keep the Town Clerk Hours: I no longer have to go to the Board for approval, to close the office, as I am elected official, I have to give notice to the Supervisor to put in the Agenda, so everyone knows when the office will be closed. Also I will put a notice on the door 14 days prior to closing the office. I have proven the last six years that I only close the Town Clerk’s office for mostly educational reasons or emergency reasons.

3.) Motion to appoint Fran Temple to the Planning Board for a 1-year Term: 2/14/2006-12/312006 to replace Jason Ballard position:

Paul Mortzheim: there shouldn’t be a need for a motion: Feels that Kitty should be able to use the Town Hall. Sally asked Kitty, why she couldn’t use the Town hall. Kitty wanted to ask first, so there weren’t any problems.
The Town Board agreed she could use the meeting room

5.) Motion to allow the Town Justice, Susan Williamee to use the Town Hall Board room for weddings.
Dee Hill: Years ago there was a motion made not to let the Town Justice use the Board room for weddings, will look up the motion for the next Town Board meeting.
Paul Stermer: it was concerning that she was being paid for the weddings.
Paul Mortzheim asked for Public comment: Bill Canfield said as long as it is a Town Function (wedding) it would be Ok.
A motion to table weddings being held in the Town Board Room until Next month’s Meeting: will look into the liabilities and will recheck past resolution.

11.) Vincent Spagnoletti: we have put black fabric down on the road, they will screen clean gravel and put 8 inch, from Gene Steinhilper's to the bottom of the hill. They will take material out, so may June July it can dry out real well. 2 coats of oil & Stone will be put down. Dust control will be under control this year. Will black top in front of houses, but can’t black top the whole road.
Our Law dept. is going after the contractor.
*Scott Casterline: Thanked Vincent for what he has done so far. Water still comes throw, the fabric; will you be cleaning the stuff off to the base?
*Vincent: this road is not a passable road, there is too much clay. We are working to make it harder and more firm. We took some off this should firm the road up. The water will keep pumping through the winter, but this summer it should dry up nicely. We will put clean gravel on the road.
*Harley: yes you need clean gravel, the mud is the problem.
*Scott Drake asked if someone can check if we can have all Lindley address in Lindley.
*Harry Pierce: (Assessor) talked about re-value for the Town of Lindley.
*Richard Pierce: not in favor of re-value.

Structure Fire on Gibson Road

Last night around 10:30 p.m. the Lindley-Presho Fire Department was called out to Kathy and Lanny Plumley's place on Gibson Road. Lawrenceville, Gang Mills, Addison, Caton, South Corning and Coopers Plains fire departments also responded because the structure fire was difficult to control. Coopers Plains Fire Department was called out to bring extra air packs for the firefighters and foam to spread on the center of the fire because water wasn't putting it out.

Firefighters returned at 6:oo a.m. this morning after a long night of getting the fire extinquished. However, it flared again this morning and the department returned at 9:30 a.m.

The family lost everything. If you wish to help please send your "cash donations" (the family doesn't have anyplace to store items) to Joyce Rhodes to help the family get back on its feet.

I copped these two photos off the internet to show what we saw the night we took the subway to Ground Zero. I'll post my photos as soon as I get them developed, but they won't show anymore than these photos do if they show anything at all. By the time we got out of class and arrived at the site it was dark and discovered there was a fence all the way around that prevented us from actually viewing the "hole" four stories below. However, the lack of a "visual" did not alter the sense of tragedy or utter devastation that we all carried in the recesses of our memories of what happened on 9/11 as we stood at the site.

Chimney Fire at Green Shingles

Looked like the boys were getting it under control. Firemen were dumping something down the chimney. Lots of smoke coming out of the stack, but I couldn't see any flames. Lawrenceville Fire Department responded also. I'll keep track, but I think they got it out. Geez Louise, what a scare. Hopefully the chimney was nice and tight to keep the flames from getting to the rafters.

1.) County Route 106 (Church Creek Road)- I’ve been working with the County in support of the 90 residents who live on County Route 106 (Church Creek Road) who are actively seeking temporary repairs this winter to reduce the adverse impact on their vehicles and safety issues that arose from a failed paving process last fall. I’ve asked several residents on Church Creek to keep me updated at all times on the condition of the road which they have been doing.

2.) Kuhl Road Detour and the Route 15 Improvement Project- I’ve been working with NYSDOT, NYS Senator George Winner, NYS Assemblyman Jim Bacalles and US Congressman Randy Kuhl in an effort to keep updated and affect pending funding/project issues related to the completion of Route 15 and doing my best to keep interested citizens knowledgeable about the funding process. (A January 18th meeting was held at the Town Hall with NYSDOT officials and representatives from George Winner and Randy Kuhl offices). A shift away from the construction of the Kuhl Road Detour was revealed during that meeting. NYSDOT is considering another detour if certain conditions are met.

3.) Updating Bookkeeping system—Kathy Biggio and I have been actively working to update the bookkeeping system in order to change the system from its current software program to another program designed to produce more detailed financial reports. When this is done the community as well as the councilmen will have a detailed account of department expenditures which will effectively enable the council to develop a yearly budget with more information at their fingertips.

4.) Working closely with Town Clerk—The Town Clerk and I have been reorganizing data and filing systems to accommodate the public when specific inquiries are made of the Town Supervisor and Town Clerk. It is our goal to return the Supervisor’s office and the Town Clerk’s office cooperative functionality as required by Town Law.

5.) Working closely with Councilmen on issues important to them—Currently researched “Bulk Mail Rates” to determine if cost effective for the Town in case the council chooses to send notices of various kinds to the public. I have discovered that some printing businesses in the Corning area have a Bulk Mail Rate service available to customers, which means the Town would not have to stand the cost of a Bulk Mail Permit.
6.) Fortuna—Am currently working with Head Assessor Guy Hill to research a taxing structure on the Fortuna natural gas infrastructure located on Ryers Creek. After an assessment procedure is determined, some monies although unknown at this time will be flowing into the Lindley tax base.

While I’ve been working on the issues listed above, my detractors, as usual, have been hyper-focused on the “minutia and politics of personal destruction” so favored by the previous leadership. It is a new day and sooner or later my detractors will catch on that I will stand firm against them when they play “Gotcha politics”. I prefer honest debate over issues of merit. Ultimately, the citizens of Lindley will determine which way they want their local government to work: Either working on issues that really matter to them or a continued wallowing in the mud of “minutia and politics of personal destruction”. And if my detractors want to keep track of how much money my council saves or brings to the Town, let’s start now. I think the letter (click on the headline "Fireside Chat" to read the letter) that I and others received speaks volumes. The floor is yours.

LINDLEY TOWN PLANNING BOARD January 16, 2006

The regular meeting of the Lindley Town Planning Board was called to order at 7:00 p.m. by Chairperson, Mary Lentzen. Members present included Gerry Gross, Jim White, Earl Titus, Mark Swan and Pat Simcoe. The CEO, Dave Fuller, and 3 visitors were also present.Minutes of the December 19 meeting were read; a Motion to accept the minutes as read was made by Earl, seconded by Jim and passed unanimously.

Mary introduced Pat Simcoe as the new member of the Board and noted that a visitor, Frances Tempel, was observing the Board meeting and may consider applying for a seat on the Board. Mary also stated the Town Board has reappointed her as Chairperson of the Planning Board for 2006.

Mary stated the New York DOT will hold a public information meeting on Wednesday, January 18, 2006, at 7:00 P.M. to discuss the State Route 15 improvement project, First mile segment to Watson Creek Road and the Khul Road connector and wetland site construction.

The CEO Permit summary Report for Dec, 2005 consisted of construction of a metal car port for Neal Hill.

The Town received a letter dated Dec. 26, 2005 from John Adams of Hamburg, NY inquiring about zoning requirements should he move to Lindley and purchase a ranch style home with 5-10 acres of land and then add a small Mother-in-Law/Guest house/cottage. The Board agreed it would be best if the home and guest house were all one unit rather than two separate buildings.

Mark will respond to Mr. Adams.The new Zoning Law went into effect December 5, 2005. Dee will have about 50 copies printed and copies will be available for about $6.00 to cover printing costs.

Gerry suggested to Dave that lots be measured not just paced off. Dave said he will purchase the tape and send the bill to the Town.

Mary stated Jennifer Fais was unavailable for tonight’s meeting as it was a Holiday. She will let Mary know how many hours she can spend on Lindley projects.

Mary asked the Board for ideas for projects and noted the land sub-division Law needs updating. The most recent Law became effective June 20, 1966.Gerry would like to see a place for a local lending library or book exchange for the Town residents. Pat suggested an awareness campaign to notify residents of the zoning laws. Earl stated signs are posted on every road into Town. Gerry stated enforcement is still the biggest problem; no recourse for those who continue to do things their way. Dave is supposed to ride all Town roads once per quarter.

Mary noted that January 1 the new Sub-Division Law became effective. NYS has amended the Real Property Law that should help the Town enforce its Subdivision Law. It states that subdivision maps must be filed with the county AND the town, otherwise a non-filing penalty can be assessed. The updating of this Law allows the Town to take action in their court and get l/3 of the penalty fees that used to go entirely to the State. The penalties collected are split l/3 to the state, 1/3 to the county and 1/3 to the town. Fines can range from $25 to $300 for each lot sold before filing the map. The previous penalty was a flat $25 to the state (same penalty since 1910).

At 7:40 P.M. Earl moved to adjourn; Jim seconded and the Motion carried unanimously.

Lost Labradors-Please Help

I know you have contact with a lot of people, or I don't know if this fits blog material or not, but I live on Preston Rd. Last week wednesday, my two labradors were on my front porch. We left them there for a few minutes alone which we have done before, few minutes later they were both gone. One is a chocolate male and the other is a yellow female. I think they both went for a walk, but someone must have found them by now. I was wondering if you had heard of anyone that has found two wonderful dogs recently?

Kuhl Road Detour-In My Opinion

Okay…this is my opinion on the status of the Kuhl Road Detour.

To begin with, NYSDOT is very unhappy with my “reporting” on the subject, so much so, they have scheduled an Informational Meeting, January 18, 2006 at the Town Hall to make sure they get to counter any “inaccurate information” floating around in the community and especially what I post on the blog. They don’t want me messing with their figures and casting doubt on their reasons why they chose to build the Kuhl Road Detour. They will also be seeking support from the community for the project to silence the impacted residents on Kuhl Road. However, if a citizen “other” than one of the Kuhl Road residents, (we are just flat out of the picture at this point), expresses a “safety concern” or feel they are “inconvenienced” by the Kuhl Road Detour at the Informational Meeting NYSDOT will investigate and implement measures to minimize any impacts or inconveniences they may incur as a result of their project. NYSDOT said they’d do the same for us, but we residents grieved our concerns already and pretty much got the door slammed in our faces. We all got “it’s a trade-off” lecture.

The problem is: Nothing I say on this blog is going to stop NYSDOT from detouring 10,000 vehicles down Kuhl Road for 6 to 8 weeks and then leaving the “temporary bridge” open until the four-lane is completed to Presho. (Insert your own time-frame when you think this is going to happen.)

To say NYSDOT’s minds are made up would be an understatement, but NOW they feel a responsibility to “inform the Town” on the Kuhl Road Detour project, four years too late.

Where were they four years ago?

In their research/information packet they sent me after I asked how in the heck didn’t the Town or the residents on Kuhl Road know anything about the Kuhl Road Detour, they said they had attended a meeting January 28, 2002 with Harold, Dick Johnson and Dee, who was there to take the minutes, to discuss the detour as well as other “first-mile” project issues. Dee, Harold and Dick said after I questioned them, the issue of the Kuhl Road Detour came up, but in no way were they left with the impression after the meeting that it was “approved”. They all said the pros and cons of the detour were briefly discussed and then dropped. Harold, Dee and Dick all said they never heard about it again and we’re as shocked as everyone else who attended the December 13th Board Meeting.

NYSDOT said in their research/information packet, “Town Officials expressed no objections to this plan at this meeting.”

Fact is: By the meeting with Harold, Dick and Dee in 2002, NYSDOT was well aware that the Kuhl Road Detour was a “go”.
Excerpt from the “research/information packet sent to Kuhl Road residents”:

Value Engineering: The use of Kuhl Rd/Watson Creek Rd for the local road connector was recommended in a Value Engineering Report dated June 2000 that was prepared by an independent consulting firm retained by NYSDOT for review of the Route 15 project. They recommended this change even though it adds cost to the project because it is safer than the “button hook” design shown in the FEIS.

But again, the January 28, 2002 meeting between NYSDOT and local officials is a moot point at this juncture in the road. It’s still not going to change the fact that Jim Ball is getting his property reduced to a postage stamp, or the fact that we’re getting “severed” from the use of our barn and the other residents on Kuhl Road will be adversely impacted for a stupid detour that belongs Back Up on Route 15 where it belongs.

Mind you, at the January 18th Informational Meeting, NYSDOT is going to lean on “safety issues” to justify the construction of the Kuhl Road Detour. Elroy Young leaned on “increased tax base for the Town and a new road for the Stevens Road residents” to get support for the Presho Landfill, and we all know how that ended.

There's been a two car collision on Route 15 at the bottom of Stowell Hill Road. There's a report of minor injuries and Rural Metro is on the way to the scene. Traffic is now stopped, but vehicles were traveling through the scene immediately after impact.

What the "Politicos" said about the Rt. 15 Funding

After a phone call to NYS Senator George Winner’s office, I have this to report about the funding process for the Route 15 Improvement Project. It goes something like this:

When we received the $20 million from the federal government and the $30 million from the passage of the New York State Transportation Bond Act, we were essentially moved to the “head of the line” to receive the “rest of the funding” from the state or federal governments for the completion of Route 15. The fact that we got “50 million already” makes Route 15 in Lindley a “committed project. The $50 million will be used as “leverage” to acquire the last stages of funding needed to complete Route 15. Think of the 50 million as “collateral”.

Now…in order for our politicians to secure the extra funding that is floating around in Washington or New York State to complete Route 15, we must “lobby” the politicians lest they “forget about us”. Things happen in our government and priorities shift. Much like what happened after 9/11 when Hillary Clinton secured money for the Route 15/I-99 Project through the NAFTA window of opportunity. That money designated for Route 15 went to New York City in the aftermath of the attack. It is highly unlikely monies will not be forthcoming to complete Route 15 because of its “committed project” status. And no, we’re not going to lose our 50 million-- it’s just going to take time to get to us.

A legal instrument called a “Memorandum of Understanding” is attached to both the federal money and state money we’ve already secured. Legally, what that means is: Everyone and their uncle knows that the $50 million is ours and is to be used to complete Route 15.

Now, the reason the 30 million from the state is not tucked in an account today somewhere in Albany totally accessible to us, is because the “bonding process behind the Bond Act” has not been structured yet but is expected to be by the summer of 2006. At that point in time, money will be “distributed” to “whoever” needs it for the Route 15 Project, quite possibly to the “design phase” that Paul McAnany referred to at the Town Board Meeting, Dec. 13th.

This is the best explanation with the information I have at the moment.

Dick Pierce: are they watching the bridge in Lawrenceville, PA-(Paul yes, they are watching the bridge and are aware and also are watching the roads. This bridge most likely will be turned back over to Steuben County.
Terry Hill: This highway is not safe. You take your life in your hands when driving this road. You have 23 million dollars, why can’t you earmark 1 ½ million for this project design? Does this money expire? (Paul-No the money doesn’t expire) Do you realize that you have put people a lot of people on hold.
Paul Stermer: once the first mile is completed- this is going to make this part of the road worse because of the funnel effect on the last five miles, it will become a death trap.
Paul Mortzheim: do you realize that the statistics (6 more people will die on this road,) before you have this project completed.
Paul McAnay: you must put pressure on Peter White (DOT) & Randy Kuhl-to get the design project started for this project. Also you need to contact George Winner, Jim Bacalles.
Paul Mortzheim: ask about the Tax Base-what is the major impact on the taxes for the Town of Lindley. The last three years we have not received any money from the trailer park, what is the ratio?-no compensation for moving the people, the town has lost a lot of taxable property.
Jake Gross: in the 1st mile, will they do the welcome center? (Paul – not at this time, but they will build the area up, there is no money at this time to build it)
Bill Canfield: Who will be the designer of the 1st mile, (Paul-it will be from in house) we will be ready when PA gets to the border.
Gerry Simcoe: the Kuhl Road detour-will you have to put a bridge on Kuhl Rd. (Paul- it will be temporary, the bridge will be taken back out when the connector is finished, the most traffic will be for the 6 to 8 weeks when route 15 is detoured down the Kuhl Rd.
Harold: should we start a letter writing campaign?
Paul McAnay: do a public informational meeting, for help to get the officials moving.
Brad Drake: someone didn’t give us the right information concerning Route 15, these people have worked very hard to get this project moving, these people shouldn’t have to go begging again to the politicians, this needs to be done!

What Happened at the Dec. 13th Board Meeting

As everyone knows the wheels of government move slower than molasses in January, and I apologize for not getting back to you sooner with an explanation. But in the last few days I’ve finally found the “language” to describe what happened at the Town Board Meeting last Tuesday night. So let’s start with what we learned from Paul McAnany, the Regional Design Engineer during his presentation at the last Board Meeting.

Paul began by telling the audience that the funding for Route 15, the 20 million from the federal government secured by Randy Kuhl and the 30 million from the passage of the New York State Transportation Bond Act was no guarantee that the entire six miles of Route 15 would be completed. Of course, this put the audience on edge because what he was saying was the direct opposite of what we all believed to be the case in light of the recently passed New York State Transportation Bond Act. Many in the audience questioned Paul about the Bond Act wanting to know why the money supposedly earmarked for the Route 15 Improvement Project was suddenly “not available” according to him. Everyone in the audience knew that Route 15 was included in the Bond Act’s project list which I posted on the blog several weeks ago. That’s why we voted for it. Paul also led us to believe that the 20 million from the federal government was unavailable to us also. So you can understand why we were “confused”.

After a round of key questioning by members of the audience, Paul began to clarify what he meant. In short, Paul explained that the money the “Lindley Route 15 Task Force”, our own lobbying group, Bill Canfield, Fran Woodring and a host of other people who have worked to secure for the completion of Route 15, was considered “leverage” to acquire even more funding for the project “in stages”. Paul went on to explain that this is the procedure once a project is considered “a committed project” and used the I-86 project to illustrate his point. He said that once the I-86 project began the money needed to complete the “entire” project was not in place. Paul said, it never is and it’s up to the politicians pushed by lobby groups (us) to continually “look” for more funding from the state or federal government to finish projects.

The next question from the audience was: “Is Route 15 a committed project?” This is where it got confusing again. Paul stated that the “first mile” was committed because of the deal New York made with Pennsylvania years ago to provide a transition mile into New York. Funds are available. He then said that the funding for the “design phase” of the project for the second mile to the sixth mile in Lindley was “Not” allocated as of yet and it was up to us to lobby the politicians to get the money for the design phase, a phase that would take around “three years” to complete. Now we all thought the six miles to be completed “were ALREADY designed”. Not true, according to Paul. We also thought that the passage of the NYS Bond Act made Route 15 a “committed project”. Not necessarily true, according to Paul.

Then, during the middle of all the confusing information, Paul casually mentioned that the “Kuhl Road Detour” was well underway as if that would give us hope that NYSDOT was “actively” working on the project. Now this is the part where I should recuse myself because I’m intimately involved, but I won’t for the sake of getting this information out, but it was quite clear from the audience’ reaction that no one knew about the imminent construction of the Kuhl Road Detour, including Larry and me. The state plans to turn Kuhl Road into a detour when the first mile of the four-lane is “connected” to the two-lane. The state plans to re-route 15,000 vehicles a day, both northbound and southbound onto Kuhl Road for six to eight weeks while the “connector” is being built. They plan to build a “temporary bridge” on Kuhl Road that will be taken out WHEN ROUTE 15 IS COMPLETED, not after the connector is finished in six to eight weeks as was reported during the board meeting. Kuhl Road becomes the local access road to Lawrenceville. Traffic volume on Kuhl Road is expected to increase a thousand fold as it will carry the combined traffic of 80% of all local and county roads in the Town of Lindley to get to Lawrenceville. Traffic from the surrounding areas outside Lindley is expected to use Kuhl Road to also avoid the “treacherous funnel effect” of a four-lane choking down into a two-lane on Route 15. Kuhl Road will become the second most heavily traveled road in the Town of Lindley aside from Route 15.

NYSDOT is telling residents on Kuhl Road right at this moment that the detour and bridge are temporary for the duration of six to eight weeks. This is simply not true. After the “connector is built”, the two-lane section of Route 15 that runs into Lawrenceville will be barricaded, and all access to residents living past the connector will be shut off. The Kuhl Road Bridge MUST remain open until the entire six miles of Route 15 are completed when “old Route 15 would re-open” and even if money were allocated tomorrow the project would not be completed in less than 15 years.

The absolute kicker to this dilemma for all affected is the fact that NYSDOT designed a “detour and access road to Lawrenceville” NEXT to the connector paralleling Route 15 where it would not adversely affect anyone and serve the same purpose as the Kuhl Road Detour. NYSDOT “abandoned” this design because they were worried about safety for their construction workers for the six to eight weeks while the connector was being built. Instead, they chose to adversely affect nine residents on Kuhl Road and spend thousands more than what the detour and access road next to the connector would have cost.

Basically, this is what we learned at meeting. What I’ve reported about the Kuhl Road Detour came from conversations with NYSDOT officials that took place after the December 13th meeting. This is an emerging story and I will keep everyone updated when I feel comfortable that I’m getting “correct” information.

LINDLEY TOWN PLANNING BOARD DECEMBER 19, 2005

The regular meeting of the Lindley Town Planning Board was called to order at 7:00 p.m. by Chairperson, Mary Lentzen. Members present included, Gerry Gross, Jason Ballard, Jim White and Earl Titus. The CEO, Dave Fuller, and six visitors were also present.

Minutes of the November 21 meeting were read. A Motion to accept the minutes as read was made by Earl, seconded by Jason and carried unanimously.

Minutes of the December 12 Public Hearing were read. A Motion to accept the minutes as read was made by Jim, seconded by Gerry and passed unanimously.

Mary noted that Jennifer Fais could not attend tonights meeting but will attend the meeting in January.

As requested at the Dec. 12, 2005 Public Hearing on the property at 485 River Road, the Board researched minutes and related documents concerning its history. In 1985 Bickley Van Duyne applied for a variance to allow placement of a mobile home which was denied. In 1996 Dan Larrison applied for a CUP to build a one story A-frame dwelling. After much study and discussion the CUP was approved but the dwelling was never built. The issues brought up in 1985 and 1996 have been addressed.

Mary also addressed each concern raised at the December 12 Public Hearing (see attached report).

Mary asked for further comments. Gerry asked Dave when he was going to measure the property?
Dave said he did not measure with a tape but did pace it off and stated the property is OK for a single wide.

The Board agreed they heard nothing in the discussions to cause them to deny the CUP request.
A Motion to approve the CUP request to place a single-wide mobile home at 485 River Road was made by Jim, seconded by Jason. The Motion carried unanimously. An Environmental Impact statement was also filed.

The CEO noted he had received notice from Allen Engineering that their charge for Perc tests will increase January 1 from the current $300 fee to $400. They also have asked that the CEO do the final inspections and give his report to the Engineering firm. If they do the final inspection, they will charge an additional $300. The Town inspection fee is $25. Dave noted residents can use any engineering firm they desire.

Earl moved to adjourn at 7:20 p.m., Gerry seconded. The Motion passed unanimously.

Special Planning Board Minutes-December

LINDLEY TOWN PLANNING BOARD December 12, 2005

At 7:00 p.m Chairperson, Mary Lentzen, called the Special Meeting to order with Board Members Manley Davis, Jim White, Jason Ballard, Mark Swan, Gerry Gross and CEO David Fuller present. Fifteen visitors were also present.

A Public Hearing began for property (Tax #406.00-01-021.000) at 485 River Road. On November 7, 2005 Katie Peterson filed for a CUP to place a 1986 singlewide (14' x 70') mobile home on her property located at 485 River Road.

Mary stated the NYState Dept. of Health policy requiring that wells must be 100 feet from a highway does not apply to a private residence; it only applies to public wells. She also stated that all prior back taxes on the property have been paid.

Jim asked Katie if her property line goes on to Mr. Lauterborn's driveway? Katie stated her lawyer notified her of the encroachment problem but said she would not make an issue of it since it did not restrict her use of her entranceway. Katie owns the entire turnaround at the top of her driveway. When asked about lot size, Katie assured the Board she had measured and re-measured and her lot complied with all the necessary zoning requirements. (No specific lot measurements were given.) Katie also stated she would be regrading so that front yard would be 50' wide and back yard would be 35' wide. Mark asked if lawn would be over her septic, not parking and Katie said that was correct.

Public Comment: Several visitors expressed concerns that the lot is an undersized lot (1.9 acres); several people have tried to place homes on the same lot over the years but were denied by the Planning Board. Mr. Burrell Morse stated that while he was CEO for the Town in 1990 someone on the Planning Board stated that no mobile home or residence would ever be allowed to occupy that lot. He suggested the Board needs to research that meeting before they make their decision on the property.

Mary stated that the current zoning law density schedule at the time of Katie's request allowed for a one acre lot. The new zoning law which became effective in December requires a 2 acre buildable lot.

Ted Lauterborn urged the Board to be thorough and consistent in their decisions and told how difficult it was for him several years ago before he was given permission to place his mobile home on his lot. He felt people are not treated uniformly; it all depends on who you are. Duane Lauterborn does not believe Katie has 50 feet from road center to her trailer and the highway curve is very dangerous near her driveway.

Katie hired an Engineer to determine her septic requirements which are different from her neighbors because the soil is different. Gerry stated the Town must abide by NYState zoning Law and is trying to clarify the Law.

Gene Smith referred to 11.9,C9 of the zoning law which says that land within a hill that is in excess of a 25% slope shall not be developed as individual residential lots. Dave has interpreted this as a buildable area for structure only as long as setbacks are met.

Dick Pierce suggested that the Board advertise that those who purchased the old Zoning Law book turn them in for the new Zoning Law book.

Harry Pierce stated there has been a history of problems with that lot; if this lot was denied before how can it be approved now? Jim stated the Board cannot differentiate between a mobile home or a stick built residence; it must have the required square footage, 840 sq ft minimum.

Steve Paulhamus stated he had no problem with trailers but was concerned about their maintenance. If this proposal meets all of the Towns requirements then there is nothing more we can do.

Mary stated the site plan presented meets all the requirements and, according to the Town Attorney, no Variance is required. The two major concerns Mary understood from the Public discussion were the steep slope and the different standards that have been used over the years.

The CEO stated Katie's final site plan must show exact measurements, if she gets her CUP, then she can move forward with a building permit application.

Gerry stated Gregg Heffner should be contacted for the County's interpretation of distances from the County Highway. The Board will also verify that the steep slope does not apply; will research the 1990 Board Minutes to see if they pointed out anything prohibiting further trailers on that lot. While the Board has 45 days to make a decision, they will try to have a decision by the next regular Board meeting, Dec. 19. Mary will call Katie if the decision is made earlier than Dec. 19, 2005.

Mary closed the Public Hearing at 8:15 pm.

I'm re-grouping efforts in the work to get Route 15 funded and completed in a "timely" manner. The Town of Lindley was "sucker punched" last night at the Board meeting. NYSDOT sent an emissary to deliver bombshell bad news on the status of the Route 15 project. Welcome to the world of bureaucrats.

When I get half a minute I'll relate what happened at the Board meeting last night. This fight ain't over yet!

Historical Perspective on Conducting War

General Lee did not return to his headquarters until 1 o’clock on the morning of July 4. Brigadier General John Imboden, commanding an irregular band of cavalry that had been liberally foraging the countryside to the west, was waiting there for him. Lee dismounted and, Imboden wrote, “threw his arm across the saddle to rest, and fixing his eyes upon the ground leaned in silence and almost motionless upon his equally weary horse,” Imboden commiserated: “General, this has been a hard day for you.”

“Yes, it has been a sad, sad day to us,” Lee replied, and then (Imboden recalled) “relapsed into his thoughtful mood and attitude.” But suddenly he roused himself to speak vigorously of the battle just fought. “I never saw troops behave more magnificently than Pickett’s division of Virginians did today in that grand charge,” he said. But, he went on, they were not supported as they were to have been—“for some reason not yet fully explained to me”—else “we would have held the position and the day would have been ours.”

Thus, if General Imboden’s account can be accepted, some nine hours after the event Robert E. Lee had convinced himself that his plan for Pickett’s Charge was perfectly sound. Only its execution had been flawed.”

The task assigned to Imboden was to organize and lead a train of wagons and ambulances to carry the army’s wounded to the Williamsport crossing of the Potomac. His route was to be westward through the Cashtown Gap in South Mountain, then a southward turning to reach Greencastle and the Williamsport Pike to the Potomac, some forty-two miles all told. In addition to the 2,100 troopers of his so-called Northwestern Brigade, Imboden was given two batteries of artillery and the assurance that the cavalry of Wade Hampton and Fitz Lee would protect his rear. As General Lee put it in his instructions, Imboden’s watchwords must be secrecy, promptness, and energy. A citizen of Greencastle who watched this army of wounded pass by put it more simply: “Hurry was the order of the day.”

Beginning about 1 p.m. on the 4th a steady, pounding rain increased Imboden’s problems manyfold, yet by 4 o’clock that afternoon he had the journey under way. He estimated this “vast procession of misery” stretched for seventeen miles. It bore between 8,000 and 8,500 wounded men, many in constant, almost unendurable agony as they jolted over the rough and rutted roads. One particularly bad stretch was known locally as the Pine Stump Road. The teamsters had strict orders: no halts for any cause whatsoever. “Of all the nights that I spent during the war I think this was the saddest,” wrote one of the escorting cavalrymen. Another trooper remembered that “the cries of the wounded and dying were awful.”

Woodstove Safety

Larry was talking with a friend from Pa. yesterday about the number of "novices" installing woodstoves. The friend said he felt sorry for the Fire Department for what was to come. Already there have been two woodstove fires in the town he lives. So I thought it would be a good idea to post safety information about operating a woodstove, especially for people who are "new" to the experience. Some of us can remember the bad fires years ago when the Oil Embargo raised gas prices and people were turning to woodstoves to heat their homes. Don't want that to happen again. LINDLEY TOWN PLANNING BOARD NOVEMBER 21, 2005

The regular meeting of the Lindley Town Planning Board was called to order at 7:00 p.m. by Chairperson, Mary Lentzen. Members present included Manley Davis, Gerry Gross and Mark Swan. The CEO, David Fuller, and 5 visitors were also present.

Minutes of the October meeting were read. A Motion to accept the Minutes as read was made by Manley, seconded by Gerry and unanimously passed.

Katie Peterson stated she applied for a CUP November 7 for her property on River Road (Tax #406.00-01-021.000) to place a singlewide mobile home and has heard nothing further. She is anxious to move on this project before winter sets in. Dave understood Diana Hill gave the paperwork to Eugene Terwilliger of the ZBA, but Dave has not seen the CUP.

Mary also has not seen the CUP; will contact Diana and asked the Board to meet again December 12 for a Public Hearing on Katie's request. A Public Hearing must be announced in the newspaper five days in advance of the Hearing.

Harley Reynolds asked the Board to amend a previously approved Minor Subdivision at 10359A Church Creek Road. Because of the location of a septic system that was installed ten years ago he had to move a lot line to comply with the 2 acre requirement. The two parcels are 2.011 and 6.062 acres split from a 40-acre parcel. Mary signed the updated map with lot line changes.

Fortuna Energy owns 10 acres on Ryers Creek Road and needs to add a gas compresser to boost flow in their pipe line. The noise level would be 55 decibels or less at the lot line; State requires 40 maximum to the nearest residence; Fortuna needs a Variance.

Mary learned from Janet Miller that Mr. Haubaker who recently purchased the Joe Young property wants to build an asphalt plant. Mary stated he will need a CUP.

A new Fee schedule for the Town of Lindley was adopted in November and becomes effective when Dee sends it in. Dave will make the forms. Gerry asked how the fee schedule will be enforced? And stated there should be a system of checks and balances. Jake stated that a paper trail is needed for whatever is done by any of the Town Boards for public information.

Dave stated currently there are no fees just the inspections required by NY State. He suggested all fees must be paid up front. He will add the inspections to his monthly report.

Mark noted that the Permits issued in the Town of Corning and posted at the construction site include a list of all the necessary inspections with the fee required for each and a place for the CEO to initial as each one is completed.

Mary noted that Jennifer Fais will attend the December meeting of the Planning Board to check on projects for 2006.

Gerry made a Motion to adjourn at 8:05 p.m.; Manley seconded; the Motion passed unanimously.

Weldon Seeks Defense Testimony on al Qaida

For those of you interested in knowing if intelligence on Al Qaida and the 9/11 hijackers existed before the attack and are vaguely familiar with an operation called ABLE DANGER, the following links I’ve posted will help you understand what’s about to happen and why. Congressman Curt Weldon (R-Pa.) vice chairman of the House Armed Services and Homeland Security Committee plans to ask the Pentagon to allow certain intelligence officers to testify about pre-September 11 investigations. If Weldon succeeds in getting the Pentagon to approve a hearing on ABLE DANGER where “operatives” of ABLE DANGER are allowed to testify the American public will be better served. At issue here is the fact that the 9/11 Commission “denied the existence of ABLE DANGER (AD)” and did not include pre-9/11 intelligence gathered by AD in their fact finding hearings. Weldon alleges “that an aide to former Clinton Justice Department official Jamie Gorelick blocked the 9/11 Commission from hearing bombshell testimony about the findings of the elite AD military intelligence team.” Jamie Gorelick was the lead Democrat on the 9/11 Commission. You need to understand the 9/11 Commission was created on the behest of a coalition of “widows of the 9/11 attack” who belonged to the Democratic Party and wanted Bush’s hide for not preventing the attacks.

Saturday, the Presho United Methodist Church held its annual bazaar. Along with vendors selling arts and crafts, the church was selling the “Tasteful Treasures Cookbook” recently created by the Women of the Presho United Methodist Church. The cookbook is filled with mouth watering “down home recipes”. I’m anxious to try a few. In fact tonight, I’m going to make the Norwegian Pancakes recipe donated by Doug and Mary Alice Swan and Jan Senkiw. Been looking for that recipe for a while. I could live on pancakes and maple syrup!

The church is selling Christmas Fudge, chocolate or peanut butter at $8.00 a 2-lb bag to benefit the Benevolent Fund. A fund set up to help people in Lindley who are victims of a fire or find themselves in need of a “hand up”. And to benefit the Board of Trustees, the church is selling Peanut Brittle for $5.00.
